GATE sells space on a board. It does not sell, rent, or broker a place. It does not forward an inquiry, book a viewing, or negotiate a price.

Ads are free right now for a licensed realtor (개업공인중개사). GATE may introduce fees later. Changes are announced at least 30 days before they apply. An ad already running stays free until the end of its term. No cost arises without the realtor’s consent. The following applies only once fees are introduced. The fee, when one exists, is an advertising fee for one ad or for a period. It is never a commission on a deal. A person looking pays GATE nothing. GATE does not hold money for a realtor or a tenant. It takes only its own fee.

The ad shows the office name, the office address, the phone, the office establishment number (개설등록번호), and the realtor’s own name. An assistant is not shown as the realtor. Only a licensed realtor (개업공인중개사) of a registered office may have an account. Owners and private persons may not post. GATE does not ask for a resident registration number or an ID-card number.

An internet ad also shows the place, the area in square metres, one price for the deposit and one price for the monthly rent, the kind of place, and the kind of deal. A building also shows the floors, the approval date, the direction, the rooms, the bathrooms, the move-in, the parking, the maintenance, and whether it is an unregistered building or an illegal building. Every ad must show the floor of the unit. A single room, a gosiwon, an officetel, an apartment, a multi-household house or a multi-room house must also show the dong; a detached house may leave the dong out. For these places, including a detached house, the floor is shown as a number of up to three digits; it may be replaced by low, mid or high only if the client (중개의뢰인) does not want the floor shown, and the office then confirms this request when entering the ad. An office, storage, lot or event space shows the floor as it is marked on site, in up to 12 characters (e.g. 3, B1, 1~2), and uses neither the dong nor low, mid or high.

The office is responsible for the ad being true. A place that does not exist, or a price that is not true, must not be posted.

Deletion and suspension. Under these terms GATE may refuse, suspend, or delete an ad for a breach of these duties, a false ad, brokerage without registration, or a registration that has ended. The same applies when an authority asks for it under the law (for example the Ministry of Land, Infrastructure and Transport). GATE tells the office the reason, suspends the ad while it is checked, and deletes it if the reason stands. This procedure is in these terms before any ad is taken down. Measures for an infringement of rights follow “Reports of infringed rights and temporary measures” below.

The lease or the sale of the place is made between the parties through the office, not with GATE. The contract for the ad is between the office and GATE.

Korean law applies. If a translation differs, the Korean text controls. There is no court outside Korea.

This applies only once fees are introduced. Refund. If the ad has not gone up, the fee is refunded in full. If GATE cancels or deletes without one of the reasons above, the fee is refunded in proportion to the unused days.

Liability. GATE does not exclude liability for intent or gross negligence. GATE does not guarantee reach or a tenant. There is no automatic renewal without a prior notice. There is no contractual penalty. Changes to these terms follow “Changes to these terms” below.

Each ad runs for 30 days. The realtor may extend it for free at any time. Without an extension it is hidden automatically. This keeps stale ads off the board. It is not a paywall. A reminder email is sent 3 days before the ad period ends. The ad does not extend itself.

One account is allowed per registered office. The office establishment number (개설등록번호) may appear only once. Staff of one office share that account. GATE may suspend duplicate accounts.

Operator. Operator: Sean Hennig (GATE), email: contact@gate4korea.com

Rights to ad content. The rights to the text and photos of an ad stay with the office that posted them. While GATE shows the ad, the office allows GATE, free of charge, to display it, to shrink or crop it to fit the screen, and to show it translated into other languages. When the ad is deleted, this permission ends. The office must hold the rights to the photos and text it posts. If they infringe someone else’s rights, the office is responsible.

Prohibited content. The following may not be posted: false or exaggerated ads; bait ads for a place that cannot actually be rented or bought; wording that discriminates by nationality, race, or similar grounds; other people’s photos or text without the rights; other people’s personal data; contact details or outside links written outside the fields meant for them; the same place advertised repeatedly.

Reports of infringed rights and temporary measures. (1) A person whose rights, such as privacy or reputation, are infringed by an ad may show the infringement and ask GATE to delete the ad (“Ask for deletion (rights)” on the report screen, or contact@gate4korea.com). They may give an email address for the result. (2) On such a request GATE takes the necessary measure, such as deletion or a temporary measure, without delay, tells the person who asked and the office that posted the ad at once, and makes the measure known to users, for example by a notice on the board (Article 44-2 of the Information and Communications Network Act). If it is hard to judge whether rights are infringed, or a dispute is expected, GATE blocks access to the ad for a time (temporary measure). The temporary measure lasts no more than 30 days. (3) Even without a request, GATE may take a temporary measure when it finds that an ad infringes someone else’s rights (Article 44-3 of the same Act). Here too the measure is made known on the board, lasts no more than 30 days, and the office is told. (4) Within the period of the temporary measure the office may object and ask for the ad to be shown again by writing to contact@gate4korea.com. This objection procedure is set by these terms, not by the Act. Before the period ends GATE decides whether the ad is shown again or deleted. If GATE has not decided by the end of the period, the temporary measure ends and the ad is hidden: it is not deleted, it is not shown again automatically, and it stays off the board. To show the ad again by editing it or extending it by 30 days, the office needs GATE's approval. Until GATE approves, the ad stays hidden. GATE tells the office by email whether it approves.

Automatic translation. Ad content shown in a language other than Korean may be an automatic translation. A translation may be wrong; the original text of the ad controls. GATE is not liable for translation errors unless it acted with intent or gross negligence.

Account care. The office keeps its password secret and does not give it to anyone outside the office. If the office learns that someone else is using the account, it tells GATE at once. If the registration details change or the registration ends, the office corrects them at once.

Leaving GATE. A realtor may leave at any time, directly on the account screen or by asking at privacy@gate4korea.com. When the account is deleted, its ads come down at once.

Changes to these terms. A change is announced on the site from 7 days before it applies. A change that is disadvantageous to the realtor is also announced by email 30 days before. A realtor who does not agree may leave before the change applies.
